We at Wing Tai Holdings Limited and our affiliates (collectively referred to as “Wing Tai Group“) take our responsibilities under Singapore’s Personal Data Protection Act 2012 (the “PDPA“) seriously. We also recognise the importance of the personal data you have entrusted to us and believe that it is our responsibility to properly manage, protect and process your personal data.
This Data Protection Policy (“Policy“) is designed to assist you in understanding how we collect, use, disclose and/or process the personal data you have provided to us, as well as to assist you in making an informed decision before providing us with any of your personal data.
This Policy applies to personal data in our possession or under our control, including personal data in the possession of organisations which we have engaged to collect, use, disclose or process personal data for our purposes.

1Introduction to the PDPA
1.1Personal Data is defined under the PDPA to mean data, whether true or not, about an individual who can be identified from that data, or from that data and other information to which an organisation has or is likely to have access. Common examples of personal data could include names, identification numbers (where necessary), contact information, medical records, photographs and video images.
1.2We will collect your personal data in accordance with the PDPA. We will notify you of the purposes for which your personal data may be collected, used, disclosed and/or processed, as well as obtain your consent for the collection, use, disclosure and/or processing of your personal data for the intended purposes, unless an exception under the law permits us to collect and/or process your personal data without your consent.
2Purposes for Collection, Use, Disclosure and Processing of Personal Data
2.1.APersonal Data Collected by Wing Tai Group’s Corporate Services Division
The personal data which we collect from you may be collected, used, disclosed and/or processed for various purposes, depending on the circumstances for which we may/will need to process your personal data, including:
(a)processing and/or responding to any enquiries or complaints made by you;
(b)processing, administering and/or managing your interest in any employment opportunities and/or job positions in Wing Tai Group;
(c)processing and/or responding to any queries made by you in relation to investment opportunities with Wing Tai Group;
(d)forwarding your personal data to the various departments and/or business units within Wing Tai Group in order for such departments and/or business units to contact you and follow up on any enquiries, indication of interests and/or complaints made by you; and
(e)any other purposes which we notify you of at the time of obtaining your consent.
2.1.BPersonal Data Collected by Wing Tai Group’s Property Division
The personal data which we collect from you (the “Applicant” being either the purchaser, tenant, resident, potential customer and/or visitor) may be collected, used, disclosed and/or processed for various purposes in relation to your interests in one (or more) of our property projects (the “Project“), depending on the circumstances for which we may/will need to process your personal data, including:
(a)processing, administering and/or managing the Applicant’s interest in purchasing or leasing the Project, or in products, services and future events, as well as future launches and promotions of Wing Tai Group;
(b)contacting the Applicant on matters relating to the Applicant’s interests in purchasing or leasing the Project, or in products, services and future events, as well as future launches and promotions of Wing Tai Group;
(c)processing and collection of the Applicant’s payment in relation to the Project, including but without limitation to the processing of the Applicant’s personal data by Wing Tai Group as well as its associated banks and legal advisors;
(d)executing the handing over of the purchased or leased property / apartment / accommodation in serviced apartment to the Applicant;
(e)contacting and following up with the Applicant during the defects liability period of purchased apartment, including but without limitation to the processing of the Applicant’s personal data by Wing Tai Group, as well as its associated contractors and suppliers;
(f)collecting of any applicable fees in relation to the purchased or leased property / apartment / accommodation in serviced apartment;
(g)granting access to the Applicant to the Project and for health reasons such as contact tracing in the event of outbreak of infectious diseases;
(h)contacting the Applicant on matters relating to the Applicant’s purchased or leased property / apartment / accommodation in serviced apartment, including but without limitation to house-keeping, obtaining feedback, building management and maintenance matters, repair and renovations works, fire drills, parking and security matters, insurance claims and measures in response to emergencies;
(i)conducting customer satisfaction surveys and customer profile analysis;
(j)inviting the Applicant to attend any corporate, arts and/or charity events and/or festive celebrations, sending wishes and/or gifts to the Applicant on birthdays and anniversaries;
(k)complying with all applicable laws, regulations and guidelines;
(l)carrying out due diligence or other screening activities (including background and verification checks) in accordance with legal or regulatory obligations or risk management procedures that may be required by law or that may have been put in place by Wing Tai Group;
(m)carrying out the Applicant’s instructions or responding to any enquiries, feedback or requests made by the Applicant;
(n)processing and sending to the Applicant marketing, advertising and promotional information on products, future events, launches and promotions of Wing Tai Group via postal mail and/or electronic mail;
(o)if so consented by the Applicant, sending the Applicant marketing, advertising and promotional information about other products/services that Wing Tai Group may be offering and which Wing Tai Group believes may be of interest or benefit to the Applicant using any or all of the communication methods which the Applicant has provided Wing Tai Group including voice call/phone call, SMS / MMS / WhatsApp (text messages) and/or fax;
(p)cross-sharing of the Applicant’s personal data within Wing Tai Group, which may be located outside of Singapore, for reporting purpose and purposes as stated in (n) and (o); and
(q)any other purpose which we notify you of at the time of obtaining your consent.
2.1.CPersonal Data Collected by Wing Tai Group’s Retail Division
The personal data which we collect from you (the “Customer“) may be collected, used, disclosed and/or processed for various purposes vis-a-vis your relationship with us, depending on the circumstances for which we may/will need to process your personal data, including:
(a)processing, administering and/or managing the Customer’s membership with us;
(b)contacting the Customer on matters relating to the Customer’s membership with us;
(c)enrolling the Customer in contests, lucky draws and similar promotions, and administering these activities. Some of these activities have additional terms and conditions, which could contain additional information about how Wing Tai Group uses and discloses the Customer’s personal data, so Wing Tai Group suggests that the Customer read these carefully;
(d)conducting customer satisfaction surveys and collecting feedback from the Customer;
(e)carrying out the Customer’s instruction or responding to any enquiries and requests made by the Customer;
(f)processing and sending to the Customer marketing, advertising and promotional information on products, future events, launches and promotions of Wing Tai Group via postal mail and/or electronic mail;
(g)if consented to by the Customer, sending the Customer marketing, advertising and promotional information about other products / services that Wing Tai Group may be offering and which Wing Tai Group believes may be of interest or benefit to the Customer using any or all of the communication methods which the Customer has provided Wing Tai Group including voice call / phone call, SMS / MMS / WhatsApp (text messages) and/or fax; and
(h)any other purposes which we notify you of at the time of obtaining your consent.
2.2The various purposes enumerated at paragraph(s) 2.1.A, 2.1B and 2.1C above are collectively referred to as the “Purposes”.
2.3As the purposes for which we may/will collect, use, disclose or process your personal data depend on the circumstances at hand, such purpose may not appear above. However, we will notify you of such other purpose at the time of obtaining your consent, unless processing of your personal data without your consent is permitted by the PDPA or by law.
2.4In order to conduct our business operations more smoothly, we may also be disclosing the personal data you have provided to us to our third party service providers, agents and/or our affiliates or related corporations, and/or other third parties whether sited in Singapore or outside of Singapore, for one or more of the above-stated Purposes. Such third party service providers, agents and/or affiliates or related corporations and/or other third parties would be processing your personal data either on our behalf or otherwise, for one or more of the above-stated Purposes. For the transfer of personal data out of Singapore, please see paragraph 6.4 below.
3Specific Issues for The Disclosure of Personal Data to Third Parties
3.1We respect the confidentiality of the personal data you have provided to us.
3.2In that regard, we will not disclose your personal data to third parties without first obtaining your consent permitting us to do so. However, please note that we may disclose your personal data to third parties without first obtaining your consent in certain situations, including, without limitation, the following:
(a)cases in which disclosure is necessary to perform the obligations in connection with the provision of services requested by you;
(b)cases in which the disclosure is required or authorised based on the applicable laws and/or regulations;
(c)cases in which the purpose of such disclosure is clearly in your interests, and if consent cannot be obtained in a timely way;
(d)cases in which the disclosure is necessary to respond to an emergency that threatens the life, health or safety of yourself or another individual;
(e)cases in which the disclosure is necessary for any investigation or proceedings;
(f)cases in which the personal data is disclosed to any officer of a prescribed law enforcement agency, upon production of written authorisation signed by the head or director of that law enforcement agency or a person of a similar rank, certifying that the personal data is necessary for the purposes of the functions or duties of the officer;
(g)cases in which the disclosure is to a public agency and such disclosure is necessary in the public interest; and/or
(h)cases in which the disclosure without your consent is permitted by the PDPA or by law.
3.3The instances listed above at paragraph 3.2 are not intended to be exhaustive. For more information on the exceptions, you are encouraged to peruse the First and Second Schedules of the PDPA which is publicly available at https://sso.agc.gov.sg/Act/PDPA2012.
3.4Where we disclose your personal data to third parties with your consent, we will employ our best efforts to require such third parties to protect your personal data.
4Request for Access and/or Correction of Personal Data
4.1You may request to access and/or correct the personal data currently in our possession or control by submitting a written request to us via email to the relevant DPO. We will need enough information from you in order to ascertain your identity as well as the nature of your request, so as to be able to deal with your request.
4.2For a request to access personal data, once we have sufficient information from you to deal with the request, we will seek to provide you with the relevant personal data within 30 calendar days. Where we are unable to respond to you within the said 30 calendar days, we will notify you of the soonest possible time within which we can provide you with the information requested. Note that the PDPA exempts certain types of personal data from being subject to your access request.
4.3For a request to correct personal data, once we have sufficient information from you to deal with the request, we will:
(a)correct your personal data within 30 calendar days. Where we are unable to do so within the said 30 calendar days, we will notify you of the soonest practicable time within which we can make the correction. Note that the PDPA exempts certain types of personal data from being subject to your correction request as well as provides for situation(s) when correction need not be made by us despite your request; and
(b)subject to paragraph 4.4, we will send the corrected personal data to every other organisation to which the personal data was disclosed by Wing Tai Group within a year before the date the correction was made, unless that other organisation does not need the corrected personal data for any legal or business purpose.
4.4Notwithstanding paragraph 4.3(b), we may, if you so consent, send the corrected personal data only to specific organisations to which the personal data was disclosed by us within a year before the date the correction was made.
4.5We may also be charging you a reasonable fee for the handling and processing of your requests to access your personal data. We will provide you with a written estimate of the fee we will be charging before we proceed with your request. Please note that we are not required to respond to or deal with your access request unless you have agreed to pay the fee.
5Request to Withdraw Consent
5.1You may withdraw your consent for the collection, use and/or disclosure of your personal data in our possession or under our control by submitting your request to the relevant DPO.
5.2We will process your request within 30 calendar days from your request in writing for withdrawal of consent, and will thereafter not collect, use and/or disclose your personal data in the manner stated in your request.
5.3However, your withdrawal of consent could result in certain legal consequences arising from such withdrawal. In this regard, depending on the extent of your withdrawal of consent for us to process your personal data, it may mean that we will not be able to continue with your existing relationship with us.
6Administration and Management of Personal Data
6.1We will take reasonable efforts to ensure that your personal data is accurate and complete, if your personal data is likely to be used by Wing Tai Group to make a decision that affects you or disclosed to another organisation. However, this means that you must also update us of any changes in your personal data that you had initially provided us with. We will not be responsible for relying on inaccurate or incomplete personal data arising from you not updating us of any changes in your personal data that you had initially provided us with.
6.2We will also put in place reasonable security arrangements to ensure that your personal data is adequately protected and secured. Appropriate security arrangements will be taken to prevent any unauthorised access, collection, use, disclosure, copying, modification, leakage, loss, damage and/or alteration of your personal data. However, we cannot assume responsibility for any unauthorised use of your personal data by third parties, which are wholly attributable to factors beyond our control.
6.3We will also put in place measures such that your personal data in our possession or under our control is destroyed and/or anonymised as soon as it is reasonable to assume that (i) the purpose for which that personal data was collected is no longer being served by the retention of such personal data; and (ii) retention is no longer necessary for any other legal or business purposes.
6.4Where your personal data is to be transferred out of Singapore, we will comply with the PDPA in doing so. In this regard, this includes us obtaining your consent unless an exception under the PDPA or law applies, and taking appropriate steps to ascertain that the foreign recipient organisation of the personal data is bound by legally enforceable obligations to provide the transferred personal data a standard of protection that is at least comparable to the protection under the PDPA. This may include us entering into an appropriate contract with the foreign recipient organisation dealing with the personal data transfer or permitting the personal data transfer without such a contract if the PDPA or law permits us to.

1.1Personal Data is defined under MY PDPA to mean data, whether true or not, about an individual who can be identified from that data, or from that data and other information to which an organisation has or is likely to have access. Reference to personal data includes sensitive personal data (such as physical or mental health condition, commission or alleged commission of offence), as and where applicable in the circumstances.
1.2We will collect your personal data in accordance with MY PDPA. We will notify you of the purposes for which your personal data may be collected, used, disclosed and/or processed, as well as obtain your consent for the collection, use, disclosure and/or processing of your personal data for the intended purposes, unless an exception under the law permits us to collect and/or process your personal data without your consent.

(h)any other purposes which we notify you of at the time of obtaining your consent.
2.2The various purposes enumerated at paragraph(s) 2.1.A, 2.1.B and 2.1.C above are collectively referred to as the “Purposes“.
2.3As the purposes for which we may/will collect, use, disclose or process your personal data depend on the circumstances at hand, such purpose may not appear above. However, we will notify you of such other purpose at the time of obtaining your consent, unless processing of your personal data without your consent is permitted by MY PDPA or by law.
2.4In order to conduct our business operations more smoothly, we may also be disclosing the personal data you have provided to us to our third party service providers, agents and/or our affiliates or related corporations, any governmental agencies, regulatory authorities and/or statutory bodies, our successor(s) in title, any assignees, transferees or any other parties involved in any corporate exercise (e.g., proposed or actual mergers and/or acquisitions, joint venture, restructuring, transfer, funding exercise, asset sale or any other matter of such nature which relates to Wing Tai Group, and/or other third parties, whether sited in Malaysia or outside of Malaysia, for one or more of the above-stated Purposes. Such third party service providers, agents and/or affiliates or related corporations and/or other third parties would be processing your personal data either on our behalf or otherwise, for one or more of the above-stated Purposes. For the transfer of personal data out of Malaysia, please see paragraph 6.4 below.
3Specific Issues for The Disclosure of Personal Data to Third Parties
3.1We respect the confidentiality of the personal data you have provided to us.
3.2If your personal data is processed in Malaysia, the following are some of the circumstances where we may disclose your personal data to third parties without first obtaining your prior consent, among others:
(a)the processing is necessary for the performance of a contract to which you are a party or for the taking of steps at your request with a view to entering into a contract;
(b)for compliance with any legal obligation to which you are the subject, other than an obligation imposed by a contract;
(c)to protect your vital interests;
(d)for the administration of justice;
(e)for the exercise of any functions conferred on any person by or under any law;
(f)necessary for the purpose of preventing or detecting a crime, or for the purpose of investigation;
(g)was required or authorized by or under any law or by the order of a court;
(h)where we acted in the reasonable belief that we had in law the right to disclose the personal data to the other person;
(i)where we acted in the reasonable belief that we would have had your consent if you had known of the disclosing of the personal data and the circumstances of such disclosure;
(j)the disclosure was justified as being in the public interest in circumstances as determined by the Minister; and/or
(k)cases in which the disclosure without your consent is permitted by MY PDPA or by law.

3.4Where we disclose your personal data to third parties with your consent, we will employ our best efforts to require such third parties to protect your personal data.
3.5We may collect and receive your personal data in a variety of ways, for instance:
(a)directly from you, when you choose to give it to ussuch as when you use our services or when you take part in any activities or events organised by us, or when you communicate with us by email, chat, telephone or any other means; and
(b)indirectly, when we obtain information from third partiessuch as identity verification services, credit reporting agencies, regulatory and enforcement agencies, public databases or sources, third parties that are connected to you (e.g. other customers that are related to you), and from such other sources to which you have given your consent to disclose your personal data.
3.6The collection of your personal data by us may be mandatory or voluntary in nature depending on the purposes for which your personal data is collected. Where it is obligatory for you to provide us with your personal data, and you fail or choose not to provide us with such data, or do not consent to the above or this Policy, we will not be able to provide products and/or services to you, employ you, enter into an agreement with you, or otherwise deal with you.
4Request for Access and/or Correction of Personal Data
4.1You may request to access and/or correct the personal data currently in our possession or control by submitting a written request to us via email to the relevant DPO. We will need enough information from you in order to ascertain your identity as well as the nature of your request, so as to be able to deal with your request.
4.2For personal data held and processed in Malaysia, your data access request will be handled in accordance with MY PDPA. To this end, we will seek to provide you with the relevant personal data within 21 calendar days from the date of the receipt of the request. Where we are unable to respond to you within the said 21 calendar days, we will notify you in writing of the soonest possible time before the end of the said 21 calendar days on the reasons why we are unable to comply with the request within 21 calendar days. Note, however, that MY PDPA also exempts certain types of personal data from being subject to your access request. If we decide to refuse your data access request as per the legal right provided to us, we will inform you of the same in writing.
4.3For personal data held and processed in Malaysia, your data correction request will be handled in accordance with MY PDPA. To this end, we will seek to correct your personal data within 21 calendar days from the date of receipt of the request and supply you with a copy of the personal data as corrected. Where we are unable to do so within the said 21 calendar days, we will notify you in writing as soon as practicable before the end of the said 21 calendar days as to the time within which we can make the correction. Note that MY PDPA also exempts certain types of personal data from being subject to your correction request, as well as provides for situation(s) when correction need not be made by us despite your request. If we decide to refuse your data correction request as per the legal right provided to us, we will inform you of the same in writing.
4.4Notwithstanding paragraph 4.3, we may, if you so consent, send the corrected personal data only to specific organisations to which the personal data was disclosed by us within a year before the date the correction was made.
4.5We may also be charging you a reasonable fee for the handling and processing of your requests to access your personal data. We will provide you with a written estimate of the fee we will be charging before we proceed with your request. Please note that we are not required to respond to or deal with your access request unless you have agreed to pay the fee.
5Request to Withdraw Consent
5.1 You may withdraw your consent for the collection, use and/or disclosure of your personal data in our possession or under our control or require for the processing of your personal data to be limited by submitting your request to the relevant DPO.
5.2We will process your request within 30 calendar days from your request in writing for withdrawal of consent, and will thereafter not collect, use and/or disclose your personal data in the manner stated in your request.
5.3However, your withdrawal of consent could result in certain legal consequences. In this regard, depending on the extent of your withdrawal of consent for us to process your personal data, it may mean that we will not be able to continue with your existing relationship with us. Where your personal data is processed for direct marketing purposes in Malaysia, please note that you may at any time request to opt out or unsubscribe from receiving further marketing communications, by informing us of your request in writing.
6Administration and Management of Personal Data
6.1We will take reasonable efforts to ensure that your personal data is accurate and complete, if your personal data is likely to be used by Wing Tai Group to make a decision that affects you or is disclosed to another organisation. However, this means that you must also update us of any changes in your personal data that you had initially provided us with. We will not be responsible for relying on inaccurate or incomplete personal data arising from you not updating us of any changes in your personal data that you had initially provided us with.
6.2We will also put in place reasonable security arrangements to ensure that your personal data is adequately protected and secured. Appropriate security arrangements will be taken to prevent any unauthorised access, collection, use, disclosure, copying, modification, leakage, loss, damage and/or alteration of your personal data. However, we cannot assume responsibility for any unauthorised use of your personal data by third parties which are wholly attributable to factors beyond our control.
6.3We will also put in place measures such that your personal data in our possession or under our control is destroyed and/or anonymised as soon as it is reasonable to assume that (i) the purpose for which that personal data was collected is no longer being served by the retention of such personal data; and (ii) retention is no longer necessary for any other legal or business purposes.
6.4For personal data collected and processed in Malaysia, any transfer of such personal data out of Malaysia will be performed in compliance with MY PDPA. In this regard, this includes us obtaining your consent unless an exception under MY PDPA or law applies, and taking appropriate steps to ascertain that the foreign recipient organisation of the personal data is bound by legally enforceable obligations to provide to the transferred personal data a standard of protection that is at least comparable to the protection under MY PDPA.

1Pengenalan kepada PDPA MY
1.1Data Peribadi ditakrifkan di bawah PDPA MY sebagai data, sama ada benar atau tidak, mengenai individu yang boleh dikenal pasti daripada data tersebut, atau daripada data tersebut dan maklumat lain yang organisasi mempunyai atau mungkin mempunyai akses kepadanya. Contoh-contoh biasa data peribadi boleh termasuk nama-nama, nombor-nombor pengenalan (jika perlu), maklumat hubungan, rekod-rekod perubatan, gambar-gambar dan imej-imej video, maklumat pekerjaan anda, dan maklumat kewangan anda, maklumat teknikal anda dan maklumat yang berkaitan dengan keutamaan-keutamaan dan minat-minat anda.
Rujukan kepada data peribadi termasuk data peribadi yang sensitif (seperti keadaan kesihatan fizikal atau mental, pelakuan kesalahan atau dakwaan melakukan kesalahan), mengikut dan di mana berkenaan dalam keadaan.
1.2Kami akan mengumpulkan data peribadi anda menurut PDPA MY. Kami akan memberitahu anda tentang tujuan-tujuan data peribadi anda mungkin dikumpul, digunakan, dizahirkan dan/atau diproses, serta mendapatkan persetujuan anda untuk pengumpulan, penggunaan, penzahiran dan/atau pemprosesan data peribadi anda untuk tujuan yang dimaksudkan, melainkan pengecualian di bawah undang-undang membenarkan kami mengumpul dan memproses data peribadi anda tanpa kebenaran anda.
2Tujuan-tujuan Pengumpulan, Penggunaan, Penzahiran dan Pemprosesan Data Peribadi
2.1.AData Peribadi Dikumpul oleh Bahagian Perkhidmatan Korporat Kumpulan Wing Tai
Data peribadi yang kami kumpulkan daripada anda mungkin dikumpul, digunakan, dizahirkan dan/atau diproses untuk pelbagai tujuan, bergantung pada keadaan yang kami mungkin/perlu memproses data peribadi anda, termasuk:
(a)memproses dan/atau menjawab sebarang pertanyaan atau aduan yang dibuat oleh anda;
(b)memproses, mentadbir dan/atau mengurus kepentingan anda dalam sebarang peluang-peluang pekerjaan dan/atau jawatan-jawatan pekerjaan dalam Kumpulan Wing Tai;
(c)memproses dan/atau menjawab sebarang pertanyaan yang dibuat oleh anda berhubung dengan peluan-peluang pelaburan dengan Kumpulan Wing Tai;
(d)memberikan data peribadi anda kepada pelbagai jabatan dan/atau unit perniagaan dalam Kumpulan Wing Tai untuk membolehkan jabatan dan/atau unit perniagaan tersebut menghubungi anda dan membuat susulan ke atas sebarang pertanyaan-pertanyaan, indikasi-indikasi minat dan/atau aduan-aduan yang dibuat oleh anda; danindent-level-2-content indent-sp(d) memberikan data peribadi anda kepada pelbagai jabatan dan/atau unit perniagaan dalam Kumpulan Wing Tai untuk membolehkan jabatan dan/atau unit perniagaan tersebut menghubungi anda dan membuat susulan ke atas sebarang pertanyaan-pertanyaan, indikasi-indikasi minat dan/atau aduan-aduan yang dibuat oleh anda; dan
(e)sebarang tujuan lain yang kami maklumkan kepada anda semasa mendapatkan persetujuan anda.
2.1.BData Peribadi yang Dikumpul oleh Bahagian Hartanah Kumpulan Wing Tai
Data peribadi yang kami kumpul daripada anda (“Pemohon“) sama ada sebagai pembeli, penyewa, pemastautin, bakal pelanggan dan/atau pelawat) boleh dikumpul, digunakan, dizahirkan dan/atau diproses untuk pelbagai tujuan berkaitan dengan kepentingan anda dalam satu (atau lebih) projek hartanah kami (“Projek“), bergantung pada keadaan yang kami mungkin/perlu memproses data peribadi anda, termasuk:
(a)memproses, mentadbir dan/atau mengurus kepentingan Pemohon dalam membeli atau memajak Projek, atau dalam produk, perkhidmatan dan acara masa hadapan, serta pelancaran dan promosi masa depan Kumpulan Wing Tai;
(b)menghubungi Pemohon mengenai perkara yang berkaitan dengan kepentingan-kepentingan Pemohon dalam membeli atau memajak Projek, atau dalam produk-produk, perkhidmatan dan acara masa depan, serta pelancaran dan promosi masa depan Kumpulan Wing Tai;
(c)pemprosesan dan pengumpulan bayaran Pemohon berhubung dengan Projek, termasuk tetapi tanpa had kepada pemprosesan data peribadi Pemohon oleh Kumpulan Wing Tai serta bank-bank berkaitan dan penasihat undang-undangnya;
(d)melaksanakan penyerahan harta/apartmen/penginapan yang dibeli atau dipajak di pangsapuri servis kepada Pemohon;
(e)menghubungi dan membuat susulan dengan Pemohon semasa tempoh liabiliti kerosakan-kerosakan pangsapuri yang dibeli, termasuk tetapi tanpa had kepada pemprosesan data peribadi Pemohon oleh Kumpulan Wing Tai serta kontraktor-kontraktor dan pembekal-pembekal yang berkaitan dengannya;
(f)mengutip apa-apa bayaran yang dikenakan berhubung dengan harta / pangsapuri / penginapan yang dibeli atau dipajak di pangsapuri perkhidmatan;
(g)memberikan akses kepada Pemohon kepada Projek dan atas sebab-sebab kesihatan seperti pengesanan kontak sekiranya berlaku wabak penyakit berjangkit;
(h)menghubungi Pemohon mengenai perkara yang berkaitan dengan harta / pangsapuri / penginapan yang dibeli atau dipajak oleh Pemohon di pangsapuri servis, termasuk tetapi tidak terhad kepada pengemasan, mendapatkan maklum balas, pengurusan bangunan dan hal-hal penyelenggaraan, kerja pembaikan dan pengubahsuaian, latihan kebakaran, hal tempat letak kereta dan keselamatan, tuntutan-tuntutan insurans dan langkah-langkah sebagai tindak balas kepada kecemasan-kecemasan;
(i)menjalankan tinjauan-tinjauan kepuasan pelanggan dan analisis-analisis profil pelanggan;
(j)menjemput Pemohon untuk menghadiri sebarang acara korporat, seni dan/atau amal dan/atau perayaan-perayaan, menghantar ucapan dan/atau hadiah kepada Pemohon pada hari lahir dan ulang tahun;
(k)mematuhi semua undang-undang, peraturan-peraturan dan garis panduan-garis panduan yang terpakai;
(l)menjalankan usaha wajar atau aktiviti-aktiviti penapisan lain (termasuk pemeriksaan latar belakang dan pengesahan) mengikut kewajipan-kewajipan undang-undang atau peraturan atau prosedur-prosedur pengurusan risiko yang mungkin diperlukan oleh undang-undang atau yang mungkin telah dilaksanakan oleh Kumpulan Wing Tai;
(m)melaksanakan arahan Pemohon atau menjawab sebarang pertanyaan, maklum balas atau permintaan yang dibuat oleh Pemohon;
(n)memproses dan menghantar kepada Pemohon maklumat pemasaran, pengiklanan dan promosi mengenai produk, acara masa depan, pelancaran dan promosi Kumpulan Wing Tai melalui mel pos dan/atau mel elektronik;
(o)jika dipersetujui oleh Pemohon, menghantar maklumat pemasaran, pengiklanan dan promosi Pemohon tentang produk-produk/perkhidmatan-perkhidmatan lain yang mungkin ditawarkan oleh Kumpulan Wing Tai dan yang dipercayai oleh Kumpulan Wing Tai boleh menarik minat atau membawa manfaat kepada Pemohon menggunakan mana-mana atau semua kaedah komunikasi yang telah disediakan oleh Pemohon kepada Kumpulan Wing Tai termasuk panggilan suara/panggilan telefon, SMS / MMS / WhatsApp (mesej-mesej teks) dan/atau faks;
(p)perkongsian silang data peribadi Pemohon dalam Kumpulan Wing Tai, yang mungkin berada di luar Singapura, untuk tujuan pelaporan dan tujuan-tujuan seperti yang dinyatakan dalam (n) dan (o); dan
(q)apa-apa tujuan lain yang kami maklumkan kepada anda pada masa mendapatkan persetujuan anda.
2.1.CData Peribadi yang Dikumpul oleh Bahagian Peruncitan Kumpulan Wing Tai
Data peribadi yang kami kumpulkan daripada anda (“Pelanggan“) mungkin dikumpul, digunakan, dizahirkan dan/atau diproses untuk pelbagai tujuan berkaitan dengan hubungan anda dengan kami, bergantung pada keadaan-keadaan yang kami mungkin/perlu memproses data peribadi anda, termasuk:
(a)memproses, mentadbir dan/atau mengurus keahlian Pelanggan dengan kami;
(b)menghubungi Pelanggan mengenai perkara yang berkaitan dengan keahlian Pelanggan dengan kami;
(c)mendaftarkan Pelanggan dalam peraduan, cabutan bertuah dan promosi yang serupa, dan mentadbir aktiviti-aktiviti ini. Sesetengah aktiviti ini mempunyai terma-terma dan syarat-syarat tambahan, yang boleh mengandungi maklumat tambahan tentang cara Kumpulan Wing Tai menggunakan dan menzahirkan data peribadi Pelanggan, jadi Kumpulan Wing Tai mencadangkan agar Pelanggan membacanya dengan teliti;
(d)menjalankan tinjauan kepuasan pelanggan dan mengumpul maklum balas daripada Pelanggan;
(e)melaksanakan arahan Pelanggan atau menjawab sebarang pertanyaan dan permintaan yang dibuat oleh Pelanggan;
(f)memproses dan menghantar kepada Pelanggan maklumat pemasaran, pengiklanan dan promosi mengenai produk, acara masa depan, pelancaran dan promosi Kumpulan Wing Tai melalui mel pos dan/atau mel elektronik;
(g)jika dipersetujui oleh Pelanggan, menghantar maklumat pemasaran, pengiklanan dan promosi Pelanggan tentang produk/perkhidmatan lain yang mungkin ditawarkan oleh Kumpulan Wing Tai dan yang dipercayai oleh Kumpulan Wing Tai mungkin menarik atau memberi manfaat kepada Pelanggan menggunakan mana-mana atau semua komunikasi kaedah yang telah disediakan oleh Pelanggan Kumpulan Wing Tai termasuk panggilan suara / panggilan telefon, SMS / MMS / WhatsApp (mesej teks) dan/atau faks; dan
(h)sebarang tujuan lain yang kami maklumkan kepada anda pada masa mendapatkan persetujuan anda.
2.2Pelbagai tujuan-tujuan yang dinyatakan di perenggan-perenggan 2.1.A, 2.1.B dan 2.1.C di atas yang secara kolektif dirujuk sebagai Tujuan-tujuan.
2.3Memandangkan tujuan-tujuan kami mungkin/akan mengumpul, menggunakan, menzahirkan atau memproses data peribadi anda bergantung pada keadaan semasa, tujuan tersebut mungkin tidak dipaparkan di atas. Walau bagaimanapun, kami akan memberitahu anda tentang tujuan lain tersebut pada masa mendapatkan persetujuan anda, melainkan pemprosesan data peribadi anda tanpa kebenaran anda dibenarkan oleh PDPA MY atau oleh undang-undang.
2.4Untuk menjalankan operasi-operasi perniagaan kami dengan lebih lancar, kami juga mungkin menzahirkan data peribadi yang anda berikan kepada kami kepada pembekal perkhidmatan pihak ketiga kami, ejen dan/atau sekutu-sekutu kami atau syarikat-syarikat berkaitan, mana-mana agensi kerajaan, pihak-pihak berkuasa kawal selia dan/atau badan-badan berkanun, pengganti(-pengganti) dalam hak milik kami, mana-mana penerima serah hak, penerima pindahan atau mana-mana pihak lain yang terlibat dalam sebarang usaha korporat (cth, cadangan atau penggabungan dan/atau pengambilalihan, usaha sama, penstrukturan semula, pemindahan, pelaksanaan pembiayaan, penjualan aset sebenar atau mana-mana perkara sedemikian yang berkaitan dengan Kumpulan Wing Tai, dan/atau pihak ketiga lain sama ada ditempatkan di Malaysia atau di luar Malaysia, untuk salah satu atau lebih akan Tujuan-tujuan yang dinyatakan di atas. Pembekal perkhidmatan pihak ketiga tersebut, ejen dan/atau sekutu atau yang berkaitan syarikat dan/atau pihak ketiga lain akan memproses data peribadi anda sama ada bagi pihak kami atau sebaliknya, untuk satu atau lebih Tujuan-Tujuan yang dinyatakan di atas. Untuk pemindahan data peribadi keluar dari Malaysia, sila lihat perenggan 6.4 di bawah.
3Isu-Isu Khas untuk Penzahiran Data Peribadi kepada Pihak Ketiga-Pihak Ketiga
3.1Kami menghormati kerahsiaan data peribadi yang anda berikan kepada kami.
3.2Jika data peribadi anda diproses di Malaysia, berikut adalah beberapa keadaan di mana kami mungkin menzahirkan data peribadi anda kepada pihak ketiga tanpa terlebih dahulu mendapatkan kebenaran anda terlebih dahulu, antara lainnya:
(a)pemprosesan adalah perlu untuk melaksanakan kontrak yang mana anda menjadi pihak atau untuk mengambil langkah atas permintaan anda dengan tujuan untuk memasuki kontrak;
(b)untuk pematuhan mana-mana kewajipan undang-undang yang mana anda tertakluk, selain daripada kewajipan yang dikenakan oleh kontrak;
(c)untuk melindungi kepentingan penting anda;
(d)untuk pentadbiran keadilan;
(e)untuk menjalankan apa-apa fungsi yang diberikan kepada mana-mana orang oleh atau di bawah mana-mana undang-undang;
(f)perlu untuk tujuan mencegah atau mengesan jenayah, atau untuk tujuan penyiasatan-penyiasatan;
(g)dikehendaki atau dibenarkan oleh atau di bawah mana-mana undang-undang atau dengan perintah mahkamah;
(h)di mana kami bertindak dengan kepercayaan munasabah bahawa kami mempunyai hak di sisi undang-undang untuk menzahirkan data peribadi kepada orang lain;
(i)di mana kami bertindak dengan kepercayaan munasabah bahawa kami akan mendapat persetujuan anda jika anda mengetahui tentang penzahiran data peribadi dan keadaan penzahiran tersebut;
(j)penzahiran itu adalah wajar untuk kepentingan awam dalam keadaan seperti yang ditentukan oleh Menteri; dan/atau
(k)kes-kes di mana penzahiran tanpa persetujuan anda dibenarkan oleh PDPA MY atau oleh undang-undang.
3.3Keadaan-keadaan yang disenaraikan di atas pada perenggan 3.2 tidak bertujuan untuk menjadi menyeluruh. Untuk maklumat lanjut tentang pengecualian-pengecualian, anda digalakkan untuk meneliti Seksyen 45 PDPA MY yang tersedia secara umum di https://www.pdp.gov.my/jpdpv2/akta-709/akta-perlindungan-data-peribadi-2010/
3.4Apabila kami menzahirkan data peribadi anda kepada pihak ketiga-pihak ketiga dengan persetujuan anda, kami akan menggunakan usaha terbaik kami untuk meminta pihak ketiga tersebut melindungi data peribadi anda.
3.5Kami mungkin mengumpul dan menerima data peribadi anda dalam pelbagai cara, contohnya:
(a)secara terus daripada anda, apabila anda memilih untuk memberikannya kepada kami seperti apabila anda menggunakan perkhidmatan-perkhidmatan kami atau apabila anda mengambil bahagian dalam sebarang aktiviti atau acara yang dianjurkan oleh kami, atau apabila anda berkomunikasi dengan kami melalui e-mel, sembang, telefon atau sebarang cara lain; dan
(b)secara tidak langsung, apabila kami memperoleh maklumat daripada pihak ketiga seperti perkhidmatan-perkhidmatan pengesahan identiti, agensi-agensi pelaporan kredit, agensi-agensi kawal selia dan penguatkuasaan, pangkalan data atau sumber awam, pihak-pihak ketiga yang berkaitan dengan anda (cth., pelanggan lain yang berkaitan dengan anda), dan daripada sumber-sumber lain yang anda telah memberikan persetujuan anda untuk menzahirkan data peribadi anda.
3.6Pengumpulan data peribadi anda oleh kami mungkin bersifat mandatori atau sukarela bergantung kepada tujuan-tujuan data peribadi anda dikumpulkan. Sekiranya anda wajib memberikan data peribadi anda kepada kami, dan anda gagal atau memilih untuk tidak memberikan data tersebut kepada kami, atau tidak bersetuju dengan Polisi ini atau di atas, kami tidak akan dapat menyediakan produk dan/atau perkhidmatan kepada anda, menggunakan anda, membuat perjanjian dengan anda, atau sebaliknya berurusan dengan anda.
4Permohonan Akses dan/atau Pembetulan Data Peribadi
4.1Anda boleh meminta untuk mengakses dan/atau membetulkan data peribadi yang ada dalam pemilikan atau kawalan kami dengan mengemukakan permintaan bertulis kepada kami melalui e-mel kepada DPO yang berkaitan. Kami akan memerlukan maklumat yang mencukupi daripada anda untuk memastikan identiti anda serta jenis permintaan anda, supaya permintaan anda dapat ditangani.
4.2Untuk data peribadi yang disimpan dan diproses di Malaysia, permintaan akses data anda akan dikendalikan mengikut PDPA MY. Untuk tujuan ini, kami akan berusaha untuk memberikan anda data peribadi yang relevan dalam masa 21 hari kalendar dari tarikh penerimaan permintaan. Untuk tujuan ini, kami akan berusaha untuk membetulkan data peribadi anda dalam masa 21 hari kalendar dari tarikh penerimaan permintaan dan membekalkan anda dengan salinan data peribadi seperti yang diperbetulkan. Sekiranya kami tidak dapat berbuat demikian dalam tempoh 21 hari kalendar tersebut, kami akan memberitahu anda secara bertulis secepat mungkin sebelum akhir 21 hari kalendar tersebut mengenai masa di mana kami boleh membuat pembetulan. Sila ambil perhatian bahawa PDPA MY juga mengecualikan jenis data peribadi tertentu daripada tertakluk kepada permintaan pembetulan anda serta menyediakan situasi(-situasi) apabila pembetulan tidak perlu dibuat oleh kami walaupun diminta oleh anda. Jika kami membuat keputusan untuk menolak permintaan pembetulan data anda mengikut hak undang-undang yang diberikan kepada kami, kami akan memaklumkan anda secara bertulis.
4.4Walau apa pun yang dinyatakan dalam perenggan 4.3, kami boleh, jika anda bersetuju, menghantar data peribadi yang telah diperbetulkan hanya kepada organisasi tertentu yang mana data peribadi tersebut telah dizahirkan oleh kami dalam tempoh setahun sebelum tarikh pembetulan dibuat.
4.5Kami juga mungkin mengenakan bayaran yang berpatutan untuk pengendalian dan pemprosesan permintaan-permintaan anda untuk mengakses data peribadi anda. Kami akan memberi anda anggaran bertulis tentang yuran yang akan kami kenakan sebelum kami meneruskan permintaan anda. Sila ambil perhatian bahawa kami tidak diminta untuk bertindak balas atau berurusan dengan permintaan akses anda melainkan anda telah bersetuju untuk membayar yuran tersebut.
5Permohonan Menarik Balik Persetujuan
5.1Anda boleh menarik balik persetujuan anda untuk pengumpulan, penggunaan dan/atau penzahiran data peribadi anda dalam simpanan kami atau di bawah kawalan kami atau memerlukan pemprosesan data peribadi anda dihadkan dengan mengemukakan permintaan anda kepada DPO yang berkaitan.
5.2Kami akan memproses permintaan anda dalam masa 30 hari kalendar dari permintaan anda secara bertulis untuk menarik balik persetujuan, dan selepas itu tidak akan mengumpul, menggunakan dan/atau menzahirkan data peribadi anda mengikut cara yang dinyatakan dalam permintaan anda.
5.3Walau bagaimanapun, penarikan balik persetujuan anda boleh mengakibatkan akibat undang-undang tertentu yang timbul daripada penarikan balik tersebut. Dalam hal ini, bergantung kepada sejauh mana penarikan balik persetujuan anda untuk kami memproses data peribadi anda, ini mungkin bermakna bahawa kami tidak akan dapat meneruskan hubungan anda yang sedia ada dengan kami. Walau bagaimanapun, kami tidak boleh bertanggungjawab terhadap sebarang penggunaan data peribadi anda yang tidak dibenarkan oleh pihak ketiga yang sepenuhnya disebabkan oleh faktor-faktor di luar kawalan kami.

6.4Untuk data peribadi yang dikumpul dan diproses di Malaysia, sebarang pemindahan data peribadi tersebut keluar dari Malaysia akan dilakukan menurut PDPA MY. Dalam hal ini, termasuklah kami akan mendapatkan persetujuan anda melainkan terdapat pengecualian di bawah PDPA MY atau undang-undang yang terpakai, dan mengambil langkah-langkah yang sesuai untuk memastikan bahawa organisasi penerima data peribadi di luar negara terikat dengan kewajipan yang boleh dikuatkuasakan secara sah untuk memberikan data peribadi yang dipindahkan tahap perlindungan yang sekurang-kurangnya setaraf dengan perlindungan di bawah PDPA MY.

We at Wing Tai Holdings Limited and our affiliates (collectively referred to as “Wing Tai Group“) take our responsibilities under Singapore’s Personal Data Protection Act 2012 (the “PDPA“) seriously and recognize the extraterritorial effect of the PRC Personal Information Protection Law (the “PIPL“). We also recognise the importance of the personal data you have entrusted to us and believe that it is our responsibility to properly manage, protect and process your personal data.

1Introduction to the PIPL
1.1Personal Data is defined under the PDPA to mean data, whether true or not, about an individual who can be identified from that data, or from that data and other information to which an organisation has or is likely to have access, but excluding information which has been anonymised. Common examples of personal data could include names, identification numbers (where necessary), contact information, medical records, photographs and video images.
1.2We will collect your personal data in accordance with the PDPA taking into consideration the requirements under the PIPL. We will notify you of the purposes for which your personal data may be collected, used, disclosed and/or processed, as well as obtain your consent for the collection, use, disclosure and/or processing of your personal data for the intended purposes, unless an exception under the law permits us to collect and/or process your personal data without your consent.
2Purposes for Collection, Use, Disclosure and Processing of Personal Data
2.1.APersonal Data Collected by Wing Tai Group’s Corporate Services Arm
The personal data which we collect from you may be collected, used, disclosed and/or processed for various purposes, depending on the circumstances for which we may/will need to process your personal data, including:
(a)processing and/or responding to any enquiries or complaints made by you;
(b)processing, administering and/or managing your interest in any employment opportunities and/or job positions in Wing Tai Group;
(c)processing and/or responding to any queries made by you in relation to investment opportunities with Wing Tai Group;
(d)forwarding your personal data to the various departments and/or business units within Wing Tai Group in order for such departments and/or business units to contact you and follow up on any enquiries, indications of interests and/or complaints made by you; and
(e)any other purposes which we notify you of at the time of obtaining your consent.
2.1.BPersonal Data Collected by Wing Tai Group’s Property Arm
The personal data which we collect from you (the “Applicant” being either the purchaser, tenant, resident, potential customer and/or visitor) may be collected, used, disclosed and/or processed for various purposes in relation to your interests in one (or more) of our property projects (the “Project“), depending on the circumstances for which we may/will need to process your personal data, including:
(a)processing, administering and/or managing the Applicant’s interest in purchasing or leasing the Project, or in products, services and future events, as well as future launches and promotions of Wing Tai Group;
(b)contacting the Applicant on matters relating to the Applicant’s interests in purchasing or leasing the Project, or in products, services and future events, as well as future launches and promotions of Wing Tai Group;
(c)processing and collection of the Applicant’s payment in relation to the Project, including but without limitation to the processing of the Applicant’s personal data by Wing Tai Group as well as its associated banks and legal advisors;
(d)executing the handing over of the purchased or leased property/apartment/accommodation in serviced apartment to the Applicant;
(e)contacting and following up with the Applicant during the defects liability period of purchased apartment, including but without limitation to the processing of the Applicant’s personal data by Wing Tai Group, as well as its associated contractors and suppliers;
(f)collecting of any applicable fees in relation to the purchased or leased property/apartment/accommodation in serviced apartment;
(g)granting access to the Applicant to the Project and for health reasons such as contact tracing in the event of outbreak of infectious diseases;
(h)contacting the Applicant on matters relating to the Applicant’s purchased or leased property/apartment/accommodation in serviced apartment, including but without limitation to house-keeping, obtaining feedback, building management and maintenance matters, repair and renovations works, fire drills, parking and security matters, insurance claims and measures in response to emergencies;
(i)conducting customer satisfaction surveys and customer profile analysis;
(j)inviting the Applicant to attend any corporate, arts and/or charity events and/or festive celebrations, sending well wishes and/or gifts to the Applicant on birthdays and anniversaries;
(k)complying with all applicable laws, regulations and guidelines;
(j)carrying out due diligence or other screening activities (including background and verification checks) in accordance with legal or regulatory obligations or risk management procedures that may be required by law or that may have been put in place by Wing Tai Group;
(m)carrying out the Applicant’s instructions or responding to any enquiries, feedback or requests made by the Applicant;
(n)processing and sending to the Applicant marketing, advertising and promotional information on products, future events, launches and promotions of Wing Tai Group via postal mail and/or electronic mail;
(o)if so consented by the Applicant, sending the Applicant marketing, advertising and promotional information about other products/services that Wing Tai Group may be offering and which Wing Tai Group believes may be of interest or benefit to the Applicant using any or all of the communication methods which the Applicant has provided Wing Tai Group including voice call/phone call, SMS / MMS / WhatsApp / such other text messaging media and/or fax;
(p)cross-sharing of the Applicant’s personal data within Wing Tai Group, which may be located outside of Singapore, for reporting purpose and purposes as stated in (n) and (o); and
(q)any other purposes which we notify you of at the time of obtaining your consent.Personal Data Collected by Wing Tai Group’s Retail Arm
2.1.CPersonal Data Collected by Wing Tai Group’s Retail Arm
The personal data which we collect from you (the “Customer“) may be collected, used, disclosed and/or processed for various purposes vis-a-vis your relationship with us, depending on the circumstances for which we may/will need to process your personal data, including:
(a)processing, administering and/or managing the Customer’s membership with us;
(b)contacting the Customer on matters relating to the Customer’s membership with us;
(c)enrolling the Customer in contests, lucky draws and similar promotions, and administering these activities. Some of these activities have additional terms and conditions, which could contain additional information about how Wing Tai Group uses and discloses the Customer’s personal data, so Wing Tai Group suggests that the Customer read these carefully;
(d)conducting customer satisfaction surveys and collecting feedback from the Customer;
(e)carrying out the Customer’s instructions or responding to any enquiries and requests made by the Customer;
(f)processing and sending to the Customer marketing, advertising and promotional information on products, future events, launches and promotions of Wing Tai Group via postal mail and/or electronic mail;
(g)if consented to by the Customer, sending the Customer marketing, advertising and promotional information about other products / services that Wing Tai Group may be offering and which Wing Tai Group believes may be of interest or benefit to the Customer using any or all of the communication methods which the Customer has provided Wing Tai Group including voice call / phone call, SMS / MMS / WhatsApp / such other text messaging media and/or fax; and
(h)any other purposes which we notify you of at the time of obtaining your consent.
2.2The various purposes enumerated at paragraphs 2.1.A, 2.1B and 2.1C above are collectively referred to as the “Purposes”.
2.3As the purposes for which we may/will collect, use, disclose or process your personal data depend on the circumstances at hand, such purpose may not appear above. However, we will notify you of such other purpose at the time of obtaining your consent, unless processing of your personal data without your consent is permitted by the PDPA, the PIPL or by applicable law.
2.4In order to conduct our business operations more smoothly, we may also be disclosing the personal data you have provided to us to our third party service providers, agents and/or our affiliates or related corporations, and/or other third parties whether sited in Singapore or outside of Singapore, for one or more of the above-stated Purposes. Such third party service providers, agents and/or affiliates or related corporations and/or other third parties would be processing your personal data either on our behalf or otherwise, for one or more of the above-stated Purposes. For the transfer of personal data out of Singapore, please see paragraph 6.4 below.
3Specific Issues for The Disclosure of Personal Data to Third Parties
3.1We respect the confidentiality of the personal data you have provided to us.
3.2In that regard, we will not disclose your personal data to third parties without first obtaining your consent permitting us to do so. However, please note that we may disclose your personal data to third parties without first obtaining your consent in certain situations, including, without limitation, the following:
(a)cases in which disclosure is necessary to perform the obligations in connection with the provision of services requested by you;
(b)cases in which the disclosure is required or authorised based on the applicable laws and/or regulations;
(c)cases in which the purpose of such disclosure is clearly in your interests, and if consent cannot be obtained in a timely way;
(d)cases in which the disclosure is necessary to respond to an emergency that threatens the life, health or safety of yourself or another individual;
(e)cases in which the disclosure is necessary for any investigation or proceedings;
(f)cases in which the personal data is disclosed to any officer of a prescribed law enforcement agency, upon production of written authorisation signed by the head or director of that law enforcement agency or a person of a similar rank, certifying that the personal data is necessary for the purposes of the functions or duties of the officer;
(g)cases in which the disclosure is to a public agency and such disclosure is necessary in the public interest; and/or
(h)cases in which the disclosure without your consent is permitted by the PDPA, the PIPL or by applicable law.
3.3The instances listed above at paragraph 3.2 are not intended to be exhaustive. For more information on the exceptions, you are encouraged to peruse the First and Second Schedules of the PDPA which is publicly available at https://sso.agc.gov.sg/Act/PDPA2012.
3.4Where we disclose your personal data to third parties with your consent, we will employ our best efforts to require such third parties to protect your personal data.
4Request for Access and/or Correction of Personal Data
4.1You may request to access and/or correct the personal data currently in our possession or control by submitting a written request to us via email to the relevant DPO. We will need enough information from you in order to ascertain your identity as well as the nature of your request, so as to be able to deal with your request.
4.2For a request to access personal data, once we have sufficient information from you to deal with the request, we will seek to provide you with the relevant personal data within 30 calendar days. Where we are unable to respond to you within the said 30 calendar days, we will notify you of the soonest possible time within which we can provide you with the information requested. Note that the PDPA and the PIPL exempts certain types of personal data from being subject to your access request.
4.3For a request to correct personal data, once we have sufficient information from you to deal with the request, we will:
(a)correct your personal data within 30 calendar days. Where we are unable to do so within the said 30 calendar days, we will notify you as soon as practicable within which we can make the correction. Note that the PDPA exempts certain types of personal data from being subject to your correction request as well as provides for situation(s) when correction need not be made by us despite your request; and
(b)subject to paragraph 4.4, we will send the corrected personal data to every other organisation to which the personal data was disclosed by Wing Tai Group within a year before the date the correction was made, unless that other organisation does not need the corrected personal data for any legal or business purpose.
4.4Notwithstanding paragraph 4.3(b), we may, if you so consent, send the corrected personal data only to specific organisations to which the personal data was disclosed by us within a year before the date the correction was made.
4.5We will also be charging you a reasonable fee for the handling and processing of your requests to access your personal data in the event of repetitious requests made during a certain period. We will provide you with a written estimate of the fee we will be charging before we proceed with your request. Please note that we are not required to respond to or deal with your access request unless you have agreed to pay the fee.
5Request to Withdraw Consent
5.1You may withdraw your consent for the collection, use and/or disclosure of your personal data in our possession or under our control by submitting your request to the relevant DPO.
5.2We will process your request within 30 calendar days from your request in writing for withdrawal of consent, and will thereafter not collect, use and/or disclose your personal data in the manner stated in your request.
5.3However, your withdrawal of consent could result in certain legal consequences. In this regard, depending on the extent of your withdrawal of consent for us to process your personal data, it may mean that we will not be able to continue with your existing relationship with us.
6Administration and Management of Personal Data
6.1We will take reasonable efforts to ensure that your personal data is accurate and complete, if your personal data is likely to be used by Wing Tai Group to make a decision that affects you or is disclosed to another organisation. However, this means that you must also update us of any changes in your personal data that you had initially provided us with. We will not be responsible for relying on inaccurate or incomplete personal data arising from you not updating us of any changes in your personal data that you had initially provided us with.
6.2We will also put in place reasonable security arrangements to ensure that your personal data is adequately protected and secured. Appropriate security arrangements will be taken to prevent any unauthorised access, collection, use, disclosure, copying, modification, leakage, loss, damage and/or alteration of your personal data. However, we cannot assume responsibility for any unauthorised use of your personal data by third parties which are wholly attributable to factors beyond our control.
6.3We will also put in place measures such that your personal data in our possession or under our control is destroyed and/or anonymised as soon as it is reasonable to assume that (i) the purpose for which that personal data was collected is no longer being served by the retention of such personal data; and (ii) retention is no longer necessary for any other legal or business purposes.
6.4Where your personal data is to be transferred out of Singapore or China, we will comply with the PDPA or the PIPL (as the case may be). In this regard, this includes us obtaining your consent unless an exception under the PDPA, the PIPL or applicable law applies, and taking appropriate steps to ascertain that the foreign recipient organisation of the personal data is bound by legally enforceable obligations to provide to the transferred personal data a standard of protection that is at least comparable to the protection under the PDPA and/or the PIPL (depending on the actual situation of transfer at that time). This may include us entering into an appropriate contract with the foreign recipient organisation dealing with the personal data transfer or permitting the personal data transfer without such a contract if the PDPA, the PIPL or applicable law permits us to.
